Quando applicare l’AIR? Il caso delle Linee guida n. 15 dell’ANAC sul conflitto di interessi nei contratti pubblici

Abstract - In relation to Guidelines no. 15, concerning conflicts of interest in public contracts, ANAC did not consider it appropriate to apply the Regulatory Impact Analysis (RIA), ignoring the opinion no. 667/2019 of the Council of State. In this perspective, the purpose of this article is to «delimit» the discretionary power of the ANAC with regard to the applicability of the RIA.
