Digital Omnibus e sovranità digitale europea: la semplificazione normativa compromette la tutela dei diritti fondamentali?

Il contributo esamina il Digital Omnibus della Commissione europea, un pacchetto di riforme della regolamentazione digitale dell’Unione che interviene su GDPR, AI Act, DSA e DMA, alla luce della tensione strutturale tra semplificazione normativa e sovranità digitale. L’analisi evidenzia come le modifiche proposte rischino di erodere le garanzie fondamentali a tutela degli utenti, favorendo gli interessi delle grandi piattaforme tecnologiche statunitensi in un contesto geopolitico segnato da crescenti pressioni deregolatorie. La sovranità digitale europea richiede infatti investimenti, coordinamento e applicazione effettiva delle norme, non la loro mera mitigazione.

The paper examines the European Commission’s Digital Omnibus, a package of reforms to the EU’s digital regulatory framework covering the GDPR, the AI Act, the DSA and the DMA, in light of the inherent tension between regulatory simplification and digital sovereignty. The analysis highlights how the proposed changes risk eroding fundamental safeguards for users, favouring the interests of large US tech platforms in a geopolitical context marked by growing deregulatory pressures. European digital sovereignty requires investment, coordination and effective enforcement of the rules, not their mitigation.
